What Constitutes Harassment

What Constitutes Harassment

  • It is any form of behaviour that is not wanted and not asked for and that Humiliates, Offends or Intimidates an employee

 

Examples of Harassment include:

  • Unnecessary or unwanted or intrusive physical contact
  • Offensive jokes, swearing, gossip, slander based on (for example) race, gender, martial status, pregnancy etc
  • Comments, verbal abuse or threats related to (for example) a person’s sex, martial status, race, ethic origin, colour, sexual orientation, disability or physical appearance
  • The display of obscene posters, graffiti, gestures (i.e pornographic materials)
  • Intimidation, humiliation, bullying, victimisation
  • Insulting or threatening language – overt or implied
  • Crude conversation or innuendo
  • Pestering, undermining
  • Threatening or abusive phone calls or emails
  • Continual and unwarranted shouting in the workplace

 

Examples of Sexual Harassment include:

  • Uninvited touching, kisses or embraces
  • Repeated invitations to go out, especially after prior refusal
  • Stalking
  • Offensive email messages or computer screen savers
  • Persistent questions or insinuations about a person’s private life
  • Touching or fiddling with a person’s clothing
  • Sex-based insults, taunts, teasing and name calling
  • Flashing or sexual gestures
